Terms of Sale

When you place an order, you are offering to purchase a product on and subject to the Terms and Conditions in this section.
To order from the Website, you must be at least 18 years of age and possess a valid credit or debit card issued by a bank acceptable to Zenzukt.
All orders are subject to availability and confirmation of the order price.
Due to availability, dispatch times may vary.
Any representations or guarantees as to delivery times are subject to postal delays and unforeseeable consequences disabling Zenzukt from fulfilling a transaction.
Zenzukt retains the right to refuse any of your requests, at its sole discretion, for any reason, with no liability to you.
After completing your order on the Website, Zenzukt will send you a confirmation email identifying the party you have contracted with (this will usually be Zenzukt).
You acknowledge and agree that all details you provide upon placing an order are true and accurate. You represent that you are an authourised user of the credit or debit card used for payment of your order, and that there are sufficient funds to cover the cost of your order.
Pricing of foreign products and services may fluctuate.
All prices advertised are subject to change.

Contract

The confirmation email verifying the receipt of your order does not constitute acceptance your order. A contract between you and Zenzukt will not be formed at the point of receiving this confirmation email. A contract will only be formed when your payment has been approved by Zenzukt and your credit or debit card have been debited.

Pricing and availability

Most of the time, the details, descriptions and prices appearing on the Website are precise. While we endeavor to always ensure accuracy, errors and glitches may occur.  If we discover an error in the price of goods you have purchased, we will contact you as soon as possible, notify you of the problem, and offer you either, a full refund, or the option to reconfirm your order at the correct price. In the event that you are not contactable, your order of the incorrectly priced items will be cancelled.
Prices appearing on the Website are inclusive of Australian GST (applied at the rate of 10%). They exclude foreign taxes, VAT and customs and excise duties.
Costs of delivery will be charged additionally and will be calculated within the total cost of your order.
While we endeavor to ensure accuracy at all times, the Service may contain typographical errors or other errors or inaccuracies, and information on the Website may be incomplete or out of date. Zenzukt reserves the right to rectify any errors or omissions, or to update any incorrect information appearing on the Website at its sole discretion, at any time, without notice (this includes, but is not limited to, mistakes, omissions or out-of-date information pertaining to pricing, shipping, payment terms or return policies).


Payment

Your payment card will only be debited once Zenzukt has conducted a pre-authorisation check to ensure you have sufficient funds to cover the costs of your order.  The dispatch of your goods will also occur after the pre-authorisation check.

 

Discount and promotion codes

Zenzukt may occasionally offer promotions, discounts or competitions to its customers. Promotional, discount or competition codes will carry their own conditions of use which will be stipulated at the time of issue.
Unless otherwise states, you are only permitted to use one promotion/discount code per order.
Selected exclusions may apply to promotions and discounts.
Promotional or discount codes cannot be used an order after that order has been placed.

Indemnification

Governing Law
These Terms and Conditions are governed by the laws of the State of Victoria, without giving effect to any principles of conflicts of law. For any action at law or in equity relating to these Terms and Conditions, you agree to resolve any dispute you have with Zenzukt exclusively in a state or federal court located in Victoria.
If any provision of these Terms and Conditions is held to be unlawful, void, or for any reason unenforceable by a court of competent jurisdiction, then that provision will be deemed severable from these Terms and Conditions and will not affect the validity and enforceability of any remaining provisions.

This dispute resolution provision will survive the termination of any or all of your transactions with Zenzukt.


Entire Agreement
The entire agreement between you and Zenzukt is stipulated by these Terms and Conditions. These Terms and Conditions govern your use of the Service and will override any former agreements between you and Zenzukt. If any provision of these Terms and Conditions is found by a court of competent jurisdiction to be invalid or otherwise unenforceable, the parties nevertheless agree that the invalid portion will be deemed severable from these Terms and Conditions and will not affect the validity and enforceability of the remaining provisions, and the remaining provisions of the Terms and Conditions remain in full force and effect. Neither the course of conduct between the parties nor trade practice will act to modify the Terms and Conditions.


Zenzukt Ethics Policy
Zenzukt is committed to providing high quality goods and fostering a relationship of trust and confidence with its customers. Zenzukt endeavors to fulfill its obligation in ensuring that the operations and conduct of its suppliers is ethical. Zenzukt expects that its suppliers are complying with their respective national employment laws and regulations pertaining to:

No harsh or inhumane treatment

Terms of employment

 

While in practical reality, Zenzukt is unable to monitor and control the conditions of workers involved in the manufacture of products from suppliers, it will nonetheless continue to take proactive steps to do everything it can to support the rights of those workers and ensure suppliers are compliant with the above principles.
